SMS Terms
These terms apply to text messages (SMS and MMS) sent through Peakify CX, a messaging service operated by Peakify Hub Inc. (“Peakify”, “we”, “us”) and used by businesses to talk with their own customers. If you received a text through the service, the business named in the message is the sender; Peakify carries it on that business’s behalf. Our Privacy Policy explains how the information in those messages is handled.
1. What you will receive
Messages are conversational and account-related: replies to a message or call you sent, appointment reminders and confirmations, follow-ups to an enquiry you made, and information you asked the business for. A business may also send you offers or updates where you have agreed to receive them. Message frequency varies by business and by conversation; there is no fixed schedule.
2. Consent
You will only be texted where the business has your consent to do so, as Canada’s Anti-Spam Legislation and, for United States numbers, the Telephone Consumer Protection Act require. Consent to receive texts is never a condition of buying anything. Texting a business first, or giving it your mobile number when you ask for something, is what lets it reply to you by text.
3. Message and data rates
Message and data rates may apply. Your carrier’s standard charges for sending and receiving text messages apply to every message, and Peakify and the business do not control them. Check your plan with your mobile carrier if you are unsure.
4. How to stop
Reply STOP to any message to opt out. We also honour UNSUBSCRIBE, CANCEL, END, QUIT and ARRET. You will get one confirmation text saying you have been unsubscribed, and then no further texts from that business’s number until you opt back in by replying START.
Opting out of one business’s texts does not opt you out of another business that uses Peakify CX; each sender is separate. It also does not stop a one-time reply to a question you ask afterwards.
5. How to get help
Reply HELP (or AIDE, or INFO) to any message and you will receive the business’s name and contact details and a reminder that you can reply STOP. You can also contact the business directly using the details in its messages, or contact us at support@peakifyhub.com about how the service works.
6. Your mobile information
Your mobile information will not be sold or shared with third parties for promotional or marketing purposes. The business you are texting with sees your number and your messages; Peakify and its carrier process them only to deliver the service, as our Privacy Policy and Sub-Processor List describe.
7. Carriers and delivery
Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and your device, and the service cannot guarantee that every message arrives or arrives promptly. The service is not an emergency service; in an emergency, call your local emergency number.
8. Businesses using the service
If you are a business sending texts through Peakify CX, your obligations, including consent records, sender identification, quiet hours and the carrier rules for registered campaigns, are set out in our Acceptable Use Policy and our guide to A2P registration and CASL.
9. Changes
We may update these terms to reflect changes in carrier rules or the law. The current version is always the one published at this address.
